Balance of Nature, a dietary supplement company, has announced that it has resumed selling and shipping its products. This comes after a court-ordered pause of its operations earlier this month due to concerns raised by the Food and Drug Administration (FDA).

In October, the FDA had requested a federal judge to block Evig LLC and Premium Productions LLC, the two Utah-based companies behind Balance of Nature, from the market. The agency cited repeated violations of manufacturing requirements, unfounded claims in the brand's marketing, and doubts about the accuracy of the product's claims.

Despite the challenges, Balance of Nature has managed to resume normal operations and shipping timelines ahead of the holiday season. The company expresses its gratitude to its customers for their patience and continuous support.

"We remain committed to delivering the highest quality products and exceptional service," said Lex Howard, CEO of Evig LLC, in a press release.

In a letter shared with CBS News, a Balance of Nature representative announced that the company had received approval from the FDA to resume manufacturing and distributing its supplements. The FDA official stated that Balance of Nature appeared to be "in compliance" with supplement regulations. However, the company was also warned that it would need to maintain compliance with the consent decree it had agreed upon with the agency in order to continue selling its Balance of Nature product.

The consent decree included a commitment from Balance of Nature to address customer complaints and remove any marketing materials that violated federal law.

At this time, the FDA has not provided any further comments on the matter.

Prior to this development, the FDA had accused Balance of Nature of making unsupported claims about the benefits of its supplements, despite previous warnings from health authorities. The brand had also settled a lawsuit in California, where it was accused of misleading advertising. Additionally, the FDA had raised concerns about the manufacturer's lack of verification regarding the ingredients used in its products.

Evig Finalizes Terms of Consent Decree with FDA

In a statement released on November 16th, Evig LLC (doing business as Balance of Nature) announced that it had voluntarily entered into a Consent Decree with the FDA. The company emphasized that it did not admit to the allegations made against it, but had chosen to enter into the agreement. Evig had already been working on a plan to address the FDA's concerns prior to the Consent Decree.

As part of the agreement, Evig stated that it was collaborating with independent experts to regularly assess its compliance with FDA regulations. The company remains committed to providing consumers with the same high-quality formulas consisting of fruits, vegetables, and fiber in dietary supplement form.
