Lawyers for an individual named Hunter filed a motion on Monday to dismiss firearms charges against him, claiming that the charges are "unprecedented, unconstitutional," according to Hunter's attorney, Abbe Lowell. The attorneys argue that the charges violate a previous diversion agreement made with Delaware U.S. Attorney and special counsel, David Weiss.
Hunter, who happens to be the child of an influential figure, is also challenging Weiss' appointment as special counsel, asserting that his role as U.S. attorney in Delaware disqualifies him from holding the position.
An indictment was brought against Hunter in September by a federal grand jury, accusing him of purchasing a firearm in October 2018 while being a drug user, according to court documents.
The four-page indictment, which was returned by the grand jury convened in Delaware, charged Hunter with three felony counts related to his possession of a Colt Cobra 38SPL revolver in October 2018. Prosecutors claimed that he unlawfully possessed the firearm for 11 days.
Hunter's attorneys argue that the charges are excessive and not supported by the facts or Justice Department policy.
